3 MONTH / 3,000 MILE BACK-TO-BASE IN-HOUSE WARRANTY

TERMS & CONDITIONS

These terms set out the conditions of the complimentary in-house warranty provided by Ben Harrison Automotive Ltd (“BHA”) with the vehicle identified on the relevant sales invoice.

This warranty is an additional contractual benefit provided by BHA. It does not replace, restrict or exclude any statutory rights or remedies available to the purchaser under the Consumer Rights Act 2015 or other applicable consumer legislation.

1. WARRANTY PERIOD

Unless otherwise stated in writing on the sales invoice, the warranty commences on the date the purchaser takes delivery of the vehicle and expires upon the earlier of:

● 3 months from the date of delivery; or

● 3,000 miles from the recorded mileage at the point of delivery.

Once either limit is reached, the warranty expires.

The warranty applies only to the vehicle identified on the sales invoice and to the original retail purchaser, unless BHA agrees otherwise in writing.

2. WARRANTY CLAIM LIMIT

The warranty provides a maximum aggregate parts claim limit of £500 including VAT for the entire warranty period.

The £500 limit is cumulative and is not a £500 limit per fault or repair.

For example, if £250 of covered parts have previously been supplied under the warranty, the maximum remaining parts allowance will be £250.

Once the £500 aggregate parts limit has been reached, no further parts will be provided under this contractual warranty.

3. BACK-TO-BASE REQUIREMENT

This warranty is strictly a back-to-base in-house warranty.

If the purchaser believes that a fault has developed, the purchaser must contact BHA as soon as reasonably practicable and provide details of the fault.

The vehicle must be returned to Ben Harrison Automotive Ltd for inspection, diagnosis and any repair provided under this warranty.

Warranty repairs will be undertaken by BHA at its premises.

The purchaser must not instruct another garage, mechanic, diagnostic centre or repairer to dismantle or repair the vehicle for the purpose of making a claim under this warranty.

BHA will not reimburse third-party diagnostic, labour, repair, parts, dismantling, storage or other costs incurred without BHA’s agreement.

Nothing in this section restricts any separate statutory right or remedy the purchaser may have under consumer law.

4. RETURNING THE VEHICLE

It is the purchaser’s responsibility to return the vehicle to BHA for assessment under this warranty.

Transportation, towing and vehicle recovery costs are not included within the contractual warranty and remain the purchaser’s responsibility.

This does not affect any circumstances in which BHA may be legally responsible for such costs under applicable consumer law.

5. WHAT THE WARRANTY COVERS

Subject to the exclusions and conditions contained within these terms, the warranty is intended to cover the unexpected mechanical or electrical failure of major components during the warranty period.

Examples of components that may be covered where failure is due to an unexpected mechanical or electrical defect include:

● Internal engine components;

● Engine oil pump;

● Timing chains and associated internal components where failure is not attributable to wear, maintenance or servicing;

● Manual or automatic gearbox internal components;

● Differential internal components;

● Driveshafts and CV joints where failure is not attributable to normal wear;

● Starter motor;

● Alternator;

● Engine management sensors;

● Engine control modules;

● Fuel pumps;

● Cooling system components including water pumps;

● Factory-fitted electrical components;

● Steering components;

● Suspension components where failure is not attributable to normal wear and tear;

● Other mechanical or electrical components accepted by BHA as having suffered a covered failure.

Coverage is subject in all cases to BHA inspecting and diagnosing the vehicle and determining whether the failure falls within the terms of this contractual warranty.

6. ITEMS NOT COVERED BY THE WARRANTY

The warranty does not cover routine servicing, maintenance items, consumable components or components that have deteriorated through normal use, age or wear and tear.

Unless BHA expressly agrees otherwise, excluded items include:

● Brake pads, brake discs and brake shoes;

● Clutch friction plates and other clutch components where failure is attributable to wear;

● Tyres and wheel alignment;

● Wiper blades;

● Bulbs and lamps;

● Batteries where deterioration is age or usage related;

● Auxiliary/drive belts;

● Filters;

● Spark plugs and glow plugs;

● Fluids, oils, lubricants, coolant and refrigerant;

● Routine servicing;

● Air-conditioning re-gassing;

● Exhaust components affected by corrosion or normal deterioration;

● Cosmetic trim;

● Interior trim and upholstery;

● Paintwork and bodywork;

● Alloy wheels and cosmetic wheel damage;

● Glass;

● Door and body seals;

● Minor rattles, squeaks and noises consistent with the vehicle’s age, mileage and condition;

● Corrosion;

● Water ingress arising from deterioration of seals, drainage channels or bodywork;

● Infotainment or navigation issues caused by software, updates, external devices or connectivity;

● Key batteries;

● Missing or damaged accessories.

An excluded component may still be considered where its failure is caused directly by a separate covered component and BHA determines that it forms a reasonable part of the covered repair.

7. WEAR AND TEAR

Used vehicles will naturally display deterioration consistent with their age, mileage, previous use and condition.

This warranty is intended to protect against qualifying mechanical or electrical failures. It is not a maintenance or refurbishment policy and does not provide for the replacement of components solely because they have become worn through normal use.

A component reaching the end of its normal serviceable life does not, by itself, constitute a failure covered by this contractual warranty.

Nothing in this section affects the purchaser’s statutory rights concerning the condition, quality, durability or fitness of the vehicle at the time of sale.

8. DIAGNOSTIC COSTS

Diagnosis undertaken by BHA in connection with a valid warranty claim will normally be carried out as part of BHA’s assessment.

Third-party diagnostic charges are not covered or reimbursable under this warranty.

Where investigation establishes that the reported issue is not covered by the warranty, BHA reserves the right to advise the purchaser of any charge before carrying out further non-warranty diagnostic or repair work.

No chargeable work will be undertaken without the purchaser’s agreement.

9. DPF, EGR AND EMISSIONS SYSTEMS

Diesel particulate filters (DPFs), EGR systems and other emissions-related components may be affected by driving style, journey type, fuel quality, maintenance and normal accumulation of deposits.

DPF regeneration, cleaning or faults arising primarily from soot accumulation, short journeys, interrupted regeneration cycles or normal maintenance requirements are not covered by this contractual warranty.

Where an emissions component suffers a distinct mechanical or electrical failure unrelated to normal maintenance or vehicle usage, BHA will assess whether the failure falls within the warranty.

10. TIMING BELTS AND SERVICE ITEMS

Where a vehicle is fitted with a scheduled timing belt/cambelt, replacement as part of the manufacturer’s normal servicing schedule is a maintenance responsibility and is not covered by this warranty.

Failure resulting from the purchaser failing to undertake required servicing or maintenance after purchase may be excluded where that failure has caused or materially contributed to the defect.

11. MODIFICATIONS AND MISUSE

The warranty may not cover a failure to the extent that it has been caused or contributed to by:

● Vehicle remapping or engine/gearbox software modification;

● Performance modifications;

● Non-standard engine, suspension, exhaust or drivetrain components;

● Motorsport, track use or competitive driving;

● Overloading;

● Incorrect fuel;

● Accident damage;

● Neglect or abuse;

● Driving the vehicle after a serious fault becomes apparent;

● Failure to maintain correct fluid levels;

● Failure to follow warning messages or warning lights;

● Improper repairs or modifications carried out after purchase.

The presence of a modification does not automatically invalidate the entire warranty. Any exclusion will relate to a failure where the modification or misuse has caused or materially contributed to that failure.

12. SERVICING AND MAINTENANCE

The purchaser is responsible for maintaining the vehicle appropriately throughout the warranty period.

Where servicing becomes due during the warranty period, it should be completed in accordance with the manufacturer’s applicable servicing requirements.

BHA may request reasonable evidence of servicing or maintenance where this is relevant to determining the cause of a claimed failure.

Failure to service or maintain the vehicle will not automatically invalidate the entire warranty but may result in a claim being declined where the lack of maintenance caused or materially contributed to the failure.

13. CONTINUED USE FOLLOWING A FAULT

The purchaser must take reasonable precautions to prevent further damage.

If a warning light, overheating condition, oil-pressure warning, abnormal mechanical noise, significant fluid leak or other potentially serious fault occurs, the purchaser should stop using the vehicle where continued use could reasonably cause further damage and contact BHA.

Damage caused or materially increased by unreasonable continued use after a serious fault became apparent may be excluded from the contractual warranty.

14. REPLACEMENT PARTS

BHA will determine the appropriate method of repair for warranty work.

Replacement components may be new, reconditioned, remanufactured or serviceable used parts, where reasonably appropriate having regard to the vehicle’s age, mileage, value and condition.

Any replacement component supplied must be of a reasonable standard and suitable for its intended purpose.

The warranty does not entitle the purchaser to insist upon manufacturer-branded or brand-new components where a suitable alternative provides an appropriate repair.

15. REPAIR TIMES

BHA will endeavour to diagnose and complete warranty repairs within a reasonable period, taking into account the nature of the fault, diagnostic requirements, workshop capacity and availability of parts.

No guaranteed completion date is provided unless specifically agreed in writing.

Parts delays or circumstances reasonably outside BHA’s control may affect repair times.

Nothing in this section limits any statutory requirement for a repair to be carried out within a reasonable time and without significant inconvenience where such a requirement applies.

16. COURTESY VEHICLES

A courtesy vehicle is not included or guaranteed under this warranty.

BHA may, at its discretion and subject to availability, provide a courtesy vehicle while a vehicle is undergoing repair.

Any courtesy vehicle provided may be subject to:

● Driver eligibility;

● Driving licence checks;

● Insurance requirements;

● Age restrictions;

● Mileage restrictions;

● Fuel requirements; and

● Separate courtesy vehicle terms.

The unavailability of a courtesy vehicle does not alter the terms or scope of the contractual warranty.

17. CONSEQUENTIAL AND INCIDENTAL COSTS

The contractual warranty does not provide cover for incidental expenses such as loss of earnings, alternative transport, taxis, hire vehicles, accommodation, missed appointments or other indirect costs arising from the vehicle being unavailable.

This exclusion relates only to the additional contractual warranty and does not exclude liability that cannot lawfully be excluded or any remedy available under applicable consumer law.

18. PRE-EXISTING OR DISCLOSED MATTERS

Any defect or condition specifically disclosed to and accepted by the purchaser before entering into the purchase may fall outside this contractual warranty where permitted by law.

The warranty does not provide an entitlement to have cosmetic imperfections or age-related characteristics that were apparent and accepted at the point of sale refurbished after purchase.

Nothing in this provision excludes statutory rights that cannot legally be excluded.

19. WARRANTY CLAIM PROCEDURE

If a fault occurs during the warranty period, the purchaser should:

1. Stop using the vehicle where continued operation may cause additional damage.

2. Contact Ben Harrison Automotive Ltd as soon as reasonably practicable.

3. Provide the vehicle registration, current mileage and a description of the fault.

4. Arrange for the vehicle to be returned to BHA.

5. Allow BHA a reasonable opportunity to inspect and diagnose the reported fault.

6. Allow BHA to carry out any repair accepted under this warranty.

The purchaser should not arrange third-party repairs and subsequently seek reimbursement from BHA under this warranty.

20. REPEAT OR SUBSEQUENT FAULTS

A repair carried out under the warranty does not restart or extend the original warranty period.

The warranty will continue only until the original 3-month or 3,000-mile expiry point, whichever occurs first.

Parts supplied under previous warranty claims count towards the £1,000 aggregate parts claim limit.

21. WARRANTY AND STATUTORY RIGHTS

This warranty is a voluntary contractual warranty provided in addition to the purchaser’s statutory rights.

The contractual requirements relating to back-to-base repairs, claim limits, exclusions, third-party costs and warranty procedures apply to claims made specifically under this warranty.

They are not intended to prevent the purchaser from exercising a separate statutory right or remedy where one exists.

In particular, nothing within these terms is intended to exclude or restrict rights available under the Consumer Rights Act 2015, including any applicable rights relating to satisfactory quality, fitness for purpose, description, repair, replacement, price reduction or rejection.
